अत्याचारों से उत्पीड़ित अनुसूचित जाति एवं जनजाति के व्यक्तियों की आर्थिक सहायता एवं पुनर्वासन योजना

(केन्द्रांश – 50 प्रतिशत, (राज्यांश – 50 प्रतिशत)

अनुसूचित जाति एवं अनुसूचित जनजाति (अत्याचार निवारण) अधिनियम – 1989 की धारा 23 की उपधारा – 1 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए सामाजिक न्याय और अधिकारिता मंत्रालय भारत सरकार द्वारा दिनांक 23.06.2014 को अधिसूचना जरी की गयी है |जिसके माध्यम से अनुशुइत जाती एवं अनुसूचित जनजाति (अत्याचार निवारण) अधिनियम – 1995 एवं संशोधन नियम – 2014 में संशोधन करते हुए अनुसूचित जाति और अनुचित जनजाति (अत्याचार निवारण) (संशोधन) नियम – 2016 बनाया गया है | प्रदेश में अत्याचारों से उत्पीड़ित अनुसूचित जाति एवं अनुसूचित जनजाति के व्यक्तियों के लिए पूर्व में स्वीकृत आर्थिक सहायता की दरों को दिनांक 14.042016 से संशोधित किया गया है उक्त योजनान्तर्गत भिन्न – भिन्न प्रकृति के प्रकरणों में अलग – अलग दरों से रहत राशि प्रदान की जाती है जिनमें मुख्य प्रकरणों का विवरण निम्नवत है –

1.	1. अखाद्य या घृणाजनक पदार्थ रखना [अधि० की धारा 3(1)(क)] 2. मल-मूल, मल पशु शव या कोई अन्य घृणाजनक पदार्थ इकट्ठा करना [अधि० की धारा(1)(ख)] 3. क्षति करने अपमानित या क्षुब्ध करने के आशय से मल-मूत्र कूड़ा पशु शव इकट्ठा करना [अधि० की धारा 3(1) (ग) 4. जूतों की माला पहनना या नग्न अर्ध नग्न घुमाना [अधि० की धारा 3(1) (घ)] 5. बलपूर्वक ऐसे कार्य करना जैसे कपड़े उतारना, बल पूर्वक सिर मुंडन करना, मूँछ हटाना, चेहरे या शरीर को पोतना [अधि० की धारा 3(1) (ड)]	पीड़ित व्यक्ति को एक लाख रूपया| पीड़ित व्यक्ति को संदाय निम्नानुसार किया जायेगा | (i) क्रम संख्यांक (1) (2) और (3) के लिए प्रथम सूचना रिपोर्ट (एफ० आई० आर०) पर 10 प्रतिशत और क्रम संख्यांक (1), (4) और (5) के लिए प्रथम सूचना रिपोर्ट प्रक्रम पर 25 प्रतिशत |  (ii) जब आरोप पत्र न्यायलय में भेजा जाता है तब 50 प्रतिशत | (iii) जब अभियुक्त व्यक्ति क्रम सं० (2) और (3) के लिए अवर न्यायालय द्वारा दोष सिद्ध कर दिया जाता है तब 40 प्रतिशत और इसी प्रकार क्रम सं० (1), (4) और (5) के लिए 25 प्रतिशत |
2.	किसी अनुसूचित जाति या जनजाति की स्त्री को साशय ऐसे कार्यों या अंगविक्षेपों का उपयोग करके जो लैंगिक प्रकृति के कार्य के रूप में हों, उसके सहमति के बिना उसे स्पर्श करना [अधि० की धारा 3(1) (ब)]	पीड़ित व्यक्ति को दो लाख रुपए | संदाय निम्नासुसर किया जायेगा | (i)प्रथम सूचना रिपोर्ट (एफ़०आई०आर०) प्रक्रम पर 25 प्रतिशत| (iii)न्यायलय को आरोप पत्र भेज दिए जाने पर 50 प्रतिशत | (iii)अवर न्यायलय द्वारा अभियुक्त के दोष सिद्ध किये जाने पर 25 प्रतिशत |
3.	बलात्संग या सामूहिक बलात्संग (I)बलात्संग (भारतीय दण्ड संहिता – 1860 का 45) की धारा 375	पीड़ित को पांच लाख रूपये, संदाय निम्नानुसार किया जायेगा | (i)चिकित्सा जांच और चिकित्सा रिपोर्ट की पुष्टि के पश्चात 50 प्रतिशत | (ii)25 प्रतिशत जब आरोप पत्र न्यायालय को भेजा जाता है | (iii)अवर न्यायालय द्वारा विचरण की समाप्ति पर 25 प्रतिशत |
4.	हत्या या मृत्यु	पीड़ित को आठ लाख पच्चीस हजार रूपये संदाय किया जायेगा|  (i)शव परीक्षा के पश्चात 50 प्रतिशत | (ii)50 प्रतिशत आरोप पत्र न्यायालय को भेजे जाने पर |

उत्पीड़न के प्रकरण पर राहत राशि जनपद स्तर पर अनुसूचित जाति, जनजाति प्रकोष्ठ से प्राप्त प्रस्ताव – अनुसार जिला समाज कल्याण अधिकारी, मुख्य विकास अधिकारी , वरिष्ठ पुलिस अधीक्षक एवं जिलाधिकारी महोदय की समिति द्वारा स्वीकृति उपरांत भुगतान की कार्यवाही संपन्न की जाती है विस्तृत जानकारी हेतु विकास भवन के कक्ष सं० 05 में स्थित जिला समाज कल्याण अधिकारी कार्यालय में संपर्क किया जा सकता है |

Financial assistance and rehabilitation scheme for Scheduled Castes and Scheduled Tribes victims of atrocities

(Central share – 50 percent, (State share – 50 percent)

The Ministry of Social Justice and Empowerment, Government of India has issued a notification on 23.06.2014, exercising the powers conferred by sub-section – 1 of Section 23 of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act – 1989. And by amending the Scheduled Tribes (Prevention of Atrocities) Act-1995 and Amendment Rules-2014, the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) (Amendment) Rules-2016 have been made. The rates of financial assistance approved earlier for Scheduled Castes and Scheduled Tribes who have been victimized by atrocities in the state have been revised from 14.04.2016. The details of the main cases are as follows –

1. Keeping inedible or obnoxious substances [Section 3(1)(a) of the Act]

2. Collecting excreta, excreta, animal carcass or any other repulsive substance [Section (1)(b) of Act.]

3. Collecting faeces, urine, animal dead bodies with the intention of causing harm, humiliation or annoyance [Section 3(1) (c) of the Act

4. Wearing garlands of shoes or roaming naked semi-naked [Section 3(1) (d) of the Act]

5. Forcibly doing such acts as taking off clothes, forcibly shaving head, removing moustache, painting face or body [Section 3(1) (e) of Act.]

One lakh rupees to the victim.

Payment will be made to the victim as follows.

(i) 10 per cent at First Information Report (FIR) for serial numbers (1), (2) and (3) and 25 per cent at First Information Report stage for serial numbers (1), (4) and (5) Percentage |

  (ii) 50 per cent when the charge sheet is sent to the court.

(iii) 40 per cent when the accused person is convicted by the lower court for serial numbers (2) and (3) and similarly 25 per cent for serial numbers (1), (4) and (5).

Intentionally touching a woman belonging to a Scheduled Caste or a Tribe by using such acts or gestures as an act of a sexual nature, without her consent [Section 3(1) (b) of the Act]

Two lakh rupees to the victim. Payment will be made as follows.

(i) 25 percent at First Information Report (FIR) stage.

(iii) 50 per cent when the charge sheet is sent to the court.

(iii) 25 per cent on conviction of the accused by the lower court.

(I) Section 375 of Rape (Indian Penal Code – 45 of 1860)

Five lakh rupees to the victim, the payment will be made as follows.

(i) 50% after medical examination and confirmation of medical report.

(ii) 25 per cent when the charge sheet is sent to the court.

(iii) 25 per cent on the conclusion of proceedings by the lower court.

murder or death

Eight lakh twenty five thousand rupees will be paid to the victim.

(i) 50% after post mortem.

(ii) 50 percent when the charge sheet is sent to the court.
